Terms of Service

1. Introduction

These Terms of Service (“Terms”) govern your use of Zoom Earth (the “App”), provided by Neave Interactive Limited (“we,” “us,” “our”), and available via the App Store, Google Play, or the website.

By accessing or using the App, you agree to be bound by these Terms, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree to these Terms, please do not use the App.

Your use of the App is also subject to our Privacy Policy, which describes how we collect and use information.

2. Licence

2.1 Use of the App

Permission is granted to access and view the materials of the App for personal, non-commercial use only. This is the grant of a licence, not a transfer of title. Under this licence you must not:

1. modify the materials;
2. use the materials for any commercial purpose;
3. access the App or its materials by automated means, such as scraping, bots, or bulk downloading;
4. attempt to decompile or reverse engineer any software contained in the App;
5. remove any copyright or other proprietary notations from the materials; or
6. transfer the materials to another person or mirror/proxy the materials on any other server.

2.2 Social Media Sharing

You may capture and share screenshots or screen recordings of the App on social media for personal, non-commercial purposes. We do not require that such content include any logo, trade mark, watermark, or attribution; however, attribution is appreciated where practical, provided that the App or its data is not misrepresented and no claim of ownership or endorsement is made.

Social sharing does not permit redistribution of the App, automated or systematic access to its materials, or any commercial or competing use.

2.3 Termination of this Licence

This licence shall automatically terminate if you violate any of these restrictions and may be terminated by us at any time. Upon termination of this licence, you must destroy any downloaded materials in your possession, whether in electronic or printed format.

3. Subscriptions

3.1 Auto-Renewable Subscriptions

The App may offer certain features or access to content through auto-renewable subscriptions (“Subscription(s)”). Subscriptions are billed on a periodic basis (e.g., monthly or annually), as specified at the time of purchase.

3.2 Payment

Payment for Subscriptions will be charged through the App Store or Google Play at the time of purchase. Subscriptions automatically renew unless cancelled in accordance with the applicable platform rules before renewal. Renewal timing, cancellation deadlines, and billing rules are handled by the applicable platform.

3.3 Cancellation

You can manage and cancel your Subscription at any time through your Apple Account or Google Play Account settings. Cancellation will take effect at the end of the current billing period. Except where applicable law or platform policies provide otherwise, you will not receive a refund for any unused portion of the current billing period.

3.4 Refunds

If you experience problems with your Subscription, please contact us for assistance. Refund requests will be reviewed on a case-by-case basis, subject to applicable law and platform policies. Except where applicable law or platform policies provide otherwise, we generally only consider refunds for annual Subscriptions within the first 30 days after purchase. Purchases made through the App Store or Google Play may also be subject to the refund policies of Apple or Google.

3.5 Price Changes

Subscription fees may change from time to time. We or the applicable platform will notify you in advance of fee changes where required. If you do not agree to a fee change, you may cancel your Subscription before the change takes effect.

3.6 Account Access

A Zoom Earth Account is optional and lets you access your Subscription across supported platforms and devices. You must be old enough to use an account under applicable law, or have any required parent or guardian permission. You are responsible for keeping your account credentials secure and for all activity under your account. We may restrict account access where required by law, platform rules, or consent settings. You can delete your account at any time through your profile. Deletion does not cancel your Subscription, if you have one.

4. Weather, Satellite, and Other Information

4.1 General Information Only

The App displays weather, satellite, radar, storm, fire, forecast, model, map, alert, and other environmental information from third-party sources and automated systems. This information is provided for general informational purposes only. It is not professional, operational, emergency, safety, navigation, aviation, marine, medical, insurance, legal, or disaster-response advice.

4.2 Accuracy and Availability

Weather and environmental information can change quickly and may be delayed, inaccurate, incomplete, unavailable, or affected by source data errors, transmission issues, processing errors, map projections, location accuracy, or display limitations. Forecasts and model outputs are predictions, not statements of fact, and may differ materially from actual conditions. We do not independently verify all information displayed in the App, we may change or remove information at any time without notice, and we make no commitment to update it.

4.3 Your Responsibility

You are solely responsible for how you interpret and use information in the App. You must not rely on the App as your only source of information, or as a substitute for official warnings, local authorities, emergency services, qualified professionals, or your own judgment. Before making any decision that could affect safety, property, travel, business, or legal obligations, you should check official and primary sources, such as your national meteorological agency and government emergency channels.

4.4 Notifications

The App may send notifications, such as storm and weather alerts. Notifications are provided as a convenience only. Delivery depends on your device, operating system, network, and settings, and notifications may be delayed, suppressed, or not delivered at all. You must not rely on notifications to warn you of severe weather or other hazards.

5. Data Sources

The App displays imagery and data sourced from various meteorological and environmental agencies around the world. We do not provide official meteorological services; the App processes, analyses, and visualises data supplied by these third-party sources. These data providers are not responsible for the interpretation, accuracy, or presentation of their data within the App, and we are not responsible for errors, delays, or omissions originating in their source data.

6. Disclaimer

The App and all materials, information, features, and services made available through it are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, representations, conditions, and guarantees, whether express or implied, including warranties of accuracy, availability, reliability, merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

We do not warrant or represent that the App will provide advance notice of weather, hazards, emergencies, or other events, or that any displayed information will match conditions at any location or time.

We do not warrant or make any representations concerning the accuracy or reliability of any other materials or websites linked to the App.

No advice or information, whether oral or written, obtained from us or through the App shall create any warranty not expressly stated in these Terms.

7. Liability and Indemnity

7.1 Excluded Losses

To the fullest extent permitted by law, we, our officers, employees, affiliates, suppliers, licensors, and data providers will not be liable for any loss, damage, claim, cost, or expense arising from or related to your access to, use of, inability to use, interpretation of, or reliance on the App or any information displayed in it. This includes, without limitation, loss or damage relating to personal decisions, safety decisions, travel, evacuation, sheltering, navigation, aviation, marine activity, property protection, business interruption, lost profits, loss of data, or reliance on delayed, inaccurate, incomplete, unavailable, or misunderstood information.

7.2 Liability Cap

To the fullest extent permitted by law, our total aggregate liability to you for all claims arising out of or relating to the App or these Terms shall not exceed the amount you have paid for the App in the twelve months before the claim arose. Nothing in this section affects any statutory rights or remedies you may have as a consumer.

7.3 Non-Excludable Liability

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence. Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities; in those jurisdictions, the above exclusions and limitations apply only to the extent permitted by law, and you may have additional rights.

7.4 Indemnity

Except where prohibited by law, you agree to indemnify and hold harmless us, our officers, employees, affiliates, suppliers, licensors, and data providers from any third-party claim, loss, damage, liability, cost, or expense (including reasonable legal fees and costs) arising from your misuse of the App, your breach of these Terms, your unlawful use of the App, or your violation of any third-party right.

8. Links

The App may contain links to third-party websites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party website or service. The inclusion of any link does not imply endorsement by us of the website or service. Use of any such linked website or service is at your own risk.

9. Intellectual Property

“Zoom Earth” ® is a registered trade mark of Neave Interactive Limited.

The materials available in the App, including but not limited to text, graphics, logos, and software, are the property of Neave Interactive Limited or its suppliers or licensors, and are protected by applicable copyright, trade mark, and other intellectual property laws.

10. Suspension and Discontinuation

We may suspend, modify, or discontinue the App, or any part of it, at any time without notice. We will not be liable for any loss or inconvenience arising from such suspension or discontinuation. Nothing in this section affects any refund you may be entitled to for a paid Subscription period not provided.

11. Modifications

We may revise these Terms from time to time. We will take reasonable steps to notify you of material changes, such as by posting the updated Terms in the App. Updated Terms take effect when they are posted or otherwise stated. By continuing to use the App after updated Terms take effect, you agree to be bound by the then current version of the Terms.

12. Governing Law and Severability

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law provisions. The courts of England and Wales shall have jurisdiction over any dispute arising from these Terms or the App, except that if you are a consumer you may also be entitled to bring proceedings in the courts of the country where you live. Nothing in these Terms affects any mandatory consumer protections you have under the laws of the country where you live.

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
